1. The Programme.
   The Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) (“Programme”) is an initiative by Government of Malaysia in collaboration by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC”) operating under the brand name “Yes”. By Your subscription or use of any of the Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Plans (as defined below), You acknowledge that You understand these Programme Terms and Conditions (“Programme T&Cs”) and agree to abide by them.
2. Eligibility.
   The Programme is open for subscription to all individuals who fulfil the following conditions:-
   (i) all individuals residing in Malaysia who are 18 years and above and in possession of a valid MyKad or MyPR or MyTentera, whichever is applicable; and
   (ii) “Penjawat Awam” who is an individual from the public services which shall consist of the federal and state general public service, the joint public services, the education service, the judicial and the legal service, the police forces and the armed forces, collectively (“Eligible Subscribers”).
3. Applicable Terms and Conditions.
   Subject only to the variations as expressly set out herein, all terms and conditions in the Postpaid Service Terms and Conditions, Postpaid Service Plans Terms and Conditions, Yes Infinite Postpaid Service Plans Programme Terms and Conditionsand Infinite Supplementary Line Service Plan Terms and Conditions available at yes.my shall remain valid and (collectively referred as “General Applicable Terms and Conditions”) are incorporated to the Programme T&Cs as if such terms and conditions were stated in full herein. In the event of any inconsistency between the General Applicable Terms and Conditions and the Programme T&Cs, these Programme T&Cs shall prevail to the extent of any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to them in the General Applicable Terms and Conditions.
4. Programme Period.
   The Programme commences on 16^th September 2023, 00:00 a.m. and continues until further notice (“Programme Period”).
5. The Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Plan & Service Offerings.
   The offerings under Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan are as follows:
   5.1 only available for purchase at Yes Store and through Yes website at yes.my.
   5.2 consists of a 5G-enabled SIM Card with the following features:
   a) a Yes Mobile Number;
   b) unlimited domestic On-Net voice calls and SMS;
   c) unlimited On-Net Service of domestic SMS; and
   d) RM10 monthly discount for twelve (12) months to the Monthly Commitment Fee (“Discount”) effective from the date of service activation only, subject to these Programme T&Cs (“Rebate Period”).
   5.3 Save for the Discount during the Rebate Period, the Monthly Commitment Fee and other charges will be applicable on the products and/or Services subscribed or used by such Eligible Subscriber, including any applicable deposit sum, in accordance with the applicable rates as more specifically stated in www.yes.my/tnc.
   5.4 After the Rebate Period, the Eligible Subscriber will be charged the Monthly Commitment Fee in accordance with the service offering of the Programme (as stated in the table below) and if such Eligible Subscriber elects to terminate the Programme (by walking in to a Yes Store), such termination are subject to the terms and conditions as set out in the Postpaid Service Plan Terms and Conditions.
   5.5 If the Eligible Subscriber’s Service account is suspended in any Billing Cycle during the Rebate Period, then the Discount will not be carried forward to the next Billing Cycle.Service Offering

   5.7 You may subscribe to the Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Plan provided always that You do not have, in aggregate, more than fifteen (15) Postpaid Service accounts with YTLC.
   5.8 When You subscribe to the Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan, You will receive a 5G enabled SIM Card, which shall be used with a compatible 5G mobile Device. Please refer to www.yes.my/supported-devices for more details on 5G compatible mobile devices.
   5.9 You are required to perform a one-time activation of the SIM Card within thirty (30) days from the date of receipt of Your SIM Card. Failing to do so shall result in automatic SIM Card expiration and Your Service account shall be terminated without notice to You. In such instance, all payment(s) (if any) made by You, including the payments for any Payable Services and/or Products and any deposits, shall be forfeited and no refund shall be made to You.
   5.10 You may enjoy the service offerings with an uncapped 5G or 4G internet speed (Internet speed will vary depending on whether You are in 5G or 4G coverage).
   5.11 Please take note that certain areas may not be under 5G network coverage. In such an instance, You will continue to enjoy uninterrupted 4G connectivity on our Yes network.
   5.12 If You have fully utilised the Hotspot Data Capacity Allocation under the respective Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan before the expiry of the relevant Billing Cycle, You may purchase a Postpaid Data Add-ons, to enjoy internet data with no speed control. For purposes of clarity, any mention of speed shall mean the optimum speed, which means the actual speed enjoyed by You may vary depending on various other factors, including but not limited to, technical and environmental factors.
   5.13 The unlimited voice call or SMS services are exclusive for Your personal person-to-person communications use in Malaysia only. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuous call forwarding, auto-dialling, machine-to-machine communication (including by using Your 5G SIM Card in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and is therefore prohibited.

6. Charges & SST
   6.1 Charges will be imposed for all International Roaming Service and IDD Service in accordance with the voice calls and SMS rates published on www.yes.my/roaming.
   6.2 For clarity, charges will apply for voice calls to special and toll free numbers, including but not limited to those numbers listed below:

   6.3 The charges stated in this Clause 6 are exclusive of SST.

7. Refund.
   There shall be no refund under the Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan for any reasons whatsoever.
8. Termination.
   Subject to the termination conditions stipulated in the General Applicable Terms and Conditions, a Yes Subscriber can terminate the Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan subscribed by issuing to YTLC a notice in YTLC prescribed format and supported by all required relevant documents for verification.
9. Limitation of Liability.
   YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan T&Cs.
10. Laws.
    The Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan T&Cs shall be governed by the laws of Malaysia under the exclusive jurisdiction of the Malaysian courts.
11. Modifications.
    YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of the Insentif Pascabayar RAHMAH Penjawat Awam (Civil Servant) Postpaid Service Plan, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to You or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend the Programme at any time before or during the Term with notice but without any liability or compensation whatsoever.
