- The Campaign.
The “Claw Your Way to the New iPhone” Campaign (“Campaign”) is a time limited Campaign launched by YTL Communications Sdn. Bhd. (“YTLC”) (Company No. 200701035605 (793634-V)) operating under the brand name “Yes” and shall be governed by these Campaign terms and conditions (“Campaign Terms”). - Campaign Eligibility.
2.1 Subject to Clauses 2.2 and 4 herein, this Campaign is open to all Malaysian residents aged 18 years and above as of the Campaign Day as defined below (“Participants”).
2.2 The following persons shall not be eligible to participate in the Campaign:
2.2.1 Employees of YTLC including its affiliates and related companies, and their respective Immediate Family Members. For clarity, Immediate Family Members means any of the following persons: spouse, parent, sibling or child.
2.2.2 Advertising or promotional agencies, dealers, retailers and representatives of YTLC. - Applicable Terms and Conditions.
Subject only to the variations as expressly set out herein (“Programme T&Cs”), all other terms and conditions incorporated in the Postpaid Service Terms and Conditions, Postpaid Service Plans Terms and Conditions, Yes Infinite Plus (with upfront payment) Service Plans Programme Terms and Conditions, Yes Infinite+ Postpaid Service Plans Programme Terms and Conditions, Yes Infinite Postpaid Service Plans Programme Terms and Conditions, Infinite Supplementary Line Service Plan Terms and Conditions, and Yes Power 35 Postpaid Service Plan Campaign available at my/tnc (collectively referred to as “General Applicable Terms and Conditions”) shall remain valid and are incorporated to these Campaign Terms as if such terms and conditions were stated in full herein. In the event of any inconsistency between the General Applicable Terms and Conditions and these Campaign Terms, these Campaign Terms shall prevail only to the extent to resolve any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to them in the General Applicable Terms and Conditions. - Campaign Day.
The Campaign Day (“Campaign Day”) is on 20th September 2024. - Campaign Mechanism.
5.1 The “Claw Your Way to the New iPhone” Campaign offers Participants the opportunity to win Products (as defined below), subject to the Campaign Terms, on the Campaign Day by attaining a Claw Ticket to operate a claw machine. Claw Ticket to participate in the “Claw Your Way to the New iPhone” Campaign may be obtained via any of the following methods:
5.1.1 Pre-Order: Visit yes.my/iPhone/ (“Campaign Website”) to Pre-Order your iPhone 16 from 13th September 2024 until 19th September 2024 (“Pre-Order Period”). Each successful Pre-Order qualifies for one (1) Claw Ticket. A valid receipt must be presented to the verification counter on the Campaign Day to obtain the physical Claw Ticket.
5.1.2 Social Media: Participate in the social Campaign on @Yes.5G on Instagram during the Social Media Campaign period. To participate in this Social Media Campaign, each Participant shall:-
5.1.2.1 Download the Instagram app from the Google Play Store or Apple App Store onto the participant’s smartphone;
5.1.2.2 Once downloaded, follow @Yes.5G on Instagram. Participants must visit the Social Campaign Announcement Post (“Social Campaign Post”) on @Yes.5G’s Instagram profile, click “Share” on the Campaign Post to add it to their story post, and tag @Yes.5G by 19th September 2024. Additionally, they must tag two (2) friends and comment “I’m coming!” in the comments section of the Campaign Post before 4pm on 19th September 2024.
5.1.2.3 Ensure that your Instagram profile is set to public mode. Participants who completed the steps above will receive an invitation via Direct Message (DM) on 19th September 2024 by 10:00 PM to qualify for one (1) Claw Ticket.
5.1.2.4 The DM invitation must be present to the verification counter on the Campaign Day to obtain the physical Claw Ticket.
5.1.3 Purchase: Buy any Yes product with a minimum value of RM30 and above at the Yes Experience Store at Lot 10, Bukit Bintang (“Yes Store”) during the Campaign Day and provide the receipt to qualifies for one (1) Claw Ticket. The receipt must be presented to the verification counter on the Campaign Day to obtain the physical Claw Ticket.
5.1.4 Existing Customers: Existing Yes Postpaid customers who receive a “Claw Your Way to the New iPhone” invitation via email or push notification through the MyYes app, qualifies for one (1) Claw Ticket. The invitation received either via email or app must be presented to the verification counter on the Campaign Day to obtain the physical Claw Ticket.
5.2 Subject to Clause 5.1 herein, to claim physical Claw Ticket Participants must do the following:
5.2.1 Visit Store: Go to the Yes Store on 20th September 2024 and visit the Yes info booth.
5.2.2 Find Yes Ambassadors: Look for a Yes Ambassador (YA) at the info booth.
5.2.3 Verification: Present your receipt (for Pre-Order and Purchase) or invitation (via DM on social media, email, or on the MyYes app) for verification.
5.2.4 Play and Win: Receive a Claw Ticket and attempt to win one of the Products (while stocks last) by playing the claw machine.
5.3 To claim and redeem the prizes from the “Claw Your Way to the New iPhone” Campaign (“Products”) at the Yes Store on the Campaign Day, Participants must agree to subscribe to one (1) Service Plan. Participants may claim and redeem the following Products offered through the “Claw Your Way to the New iPhone” Campaign:
5.3.1 purchase the new iPhone 16 (worth RM3,999.00) at RM1.00 in accordance with Clause 7.1 herein; or
5.3.2 purchase the new iPhone 15 (worth RM4,399.00) at RM1.00 in accordance with Clause 7.1 herein; or
5.3.3 purchase the new iPhone 14 (worth RM3,799.00) at RM1.00 in accordance with Clause 7.1 herein; or
5.3.4 purchase the new iPhone 13 (worth RM3,299.00) at RM1.00 in accordance with Clause 7.1 herein; or
5.3.5 redeem one (1) unit of AirPods (3rd Generation) (worth RM835.00) with the subscription of a Yes iPhone Plan; and
5.3.6 redeem one (1) unit of an iPhone compatible power adapter (worth RM99) with the subscription of a Yes iPhone Plan.
5.4 At any time during this Campaign, YTLC and its authorized personnel reserve the right to review all Participants’ Claw Ticket and attempts at the claw machine.
5.5 During the Campaign Day, Participants may obtain multiple Claw Tickets, subject to Clause 5.1.
5.6 Each Participant is entitled to participate in the “Claw Your Way to the New iPhone” Campaign only once per Claw Ticket and can redeem only one (1) of any of the Products.
5.7 If a Participant is successful in obtaining a Product from the Claw Machine, it may be redeemed in accordance to Clause 5.3. - Product Redemption.
6.1 The Participants shall not be entitled to redeem this Campaign in any other form or manner other than those specified in these Campaign Terms.
6.2 The Participants agree that this Campaign is accepted at the risk of the Participants and is organised by YTLC and/or its sponsors without any warranty of any kind, whether express or implied unless otherwise stated in writing by YTLC.

7.2 Each Participant is entitled to register for one (1) Plan, provided that the Participant does not have in aggregate more than fifteen (15) Postpaid service accounts with Yes.
7.3 When the Participant successfully subscribes to a Plan (hereinafter referred to as “Yes Subscriber”), the Yes Subscriber will receive a Yes SIM.
7.4 The Yes Subscriber may enjoy the service offerings with an uncapped 5G or 4G internet speed (Internet speed will vary depending on whether the Subscriber is in 5G or 4G coverage).
7.5 Please take note that certain areas may not be under 5G network coverage. In such an instance, the Yes Subscriber will continue to enjoy uninterrupted 4G connectivity on the Yes network.
7.6 The Data Capacity Allocation for Hotspot may be used only during the relevant Billing Cycle. In the event there is any unused Data Capacity Allocation for Hotspot at the end of a particular Billing Cycle, such unused balance Data Capacity Allocation for Hotspot will not be carried forward to any of the succeeding Billing Cycle and there shall be no refund from or liability on YTLC.
7.7 If the Yes Subscriber has fully utilised the Data Capacity Allocation for Hotspot before the expiry of the relevant billing Cycle, the Yes Subscriber may purchase a Postpaid Data Add-On to enjoy internet data with no speed control. For clarity, any mention of speed shall mean the optimum speed at which the actual speed enjoyed by the Yes Subscriber may vary depending on various other factors including but not limited to technical and environmental factors.
7.8 The unlimited On-Net Services are exclusive for the Yes Subscriber’s use in Malaysia only and applicable for communications between person-to-person personal use and not commercial use. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication (including by using the Yes SIM in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and are therefore prohibited.
7.9 If a Yes Subscriber defaults in making full payments under his/her Service Plan(s), YTLC reserves the right to bar or suspend the Services and block the Device IMEI. YTLC will unblock the Device IMEI within three (3) working days upon settlement of all outstanding payments due under the Service Plan(s). Notwithstanding the suspension of the Service Plan(s), a Yes Subscriber’s commitment to pay the Commitment Fee shall continue during the period of suspension.
7.10 Upon suspension or termination of a Yes Subscriber’s Service Plan(s), YTLC reserves the right to forward such Yes Subscriber’s details to CTOS for the purposes of blacklisting under the CTOS record which will only be removed from the CTOS blacklist upon full settlement of all outstanding amounts. - Exclusions.
8.1 The Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon participation. YTLC reserves the right to refuse the participation, or refuse to award and/or allow the redemption of the Device to any person if YTLC in its absolute discretion believes that such person is not eligible under these terms and conditions to participate in the Campaign or may have breached, will breach, or has breached any of these terms and conditions. YTLC further reserves the right at its sole and absolute discretion to disqualify any Participants who tamper with or cheat with the processes of this Campaign and/or its mechanics and YTLC may take any action (including legal action) against such Participant.
8.2 Any and all expenses incurred for the participation of the Campaign, including tax liabilities (if any) in relation to the Campaign, the Plan and/or use or enjoyment of the same, shall be the sole responsibility of and borne by the Participants. YTLC shall not be held liable for (a) any delay in performing or partial or total failure to perform any of its obligations under the Campaign to the Participants if such delay or failure is caused by circumstances beyond the reasonable control of YTLC, its affiliates, authorized dealers/distributors, agents or suppliers; and (b) any losses, damage to property, injury, or death resulting from or related to such Participant’s participation or inability to participate in this Campaign, or the use, misuse or inability to use the Campaign or part thereof. - Warranty.
Any Device(s) provided under the Yes Postpaid RM1 iPhone Plan, Yes iPhone Plan and/or the Service Plan(s) is/are subject to the Device(s) manufacturer’s warranty. Please refer to the manufacturer’s warranty as provided with the Device(s) or on the Device(s) manufacturer’s website. - Exclusion of liability for use of the Device.
YTLC shall not be liable to any Yes Subscriber or any person(s) claiming through them for any loss, damages or injury arising from the use or inability to use the Device from any cause whatsoever. - Refund.
There shall be no refund under the Yes Postpaid RM1 iPhone Plan, Yes iPhone Plan and/or the Service Plan(s) for any reasons whatsoever. - Upgrade/Downgrade.
The Yes Subscriber shall not upgrade or downgrade their Plan during the Contract Period. - Unconditional Agreement.
The acceptance of the Campaign constitutes the Participant’s unconditional agreement and permission to YTLC and/or its agents to use the Campaign Participant’s name, video footage, voice, photograph and/or likeness for purposes of advertising, editorial, Campaign, promotional marketing, trade and/or other purposes without further compensation and notice, unless prohibited by law. YTLC fully reserves its rights to such forms of publicity and publication. - Laws.
These Campaign Terms shall in all respects be governed by the laws of Malaysia. - Modifications.
YTLC reserves the right to add, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Campaign, in whole or in part, at any time and from time to time and at its sole discretion, without notice and without liability to the Participants or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend this Campaign at any time before or during the Campaign Period without any liability or compensation whatsoever. In the event of such cancellation, termination or suspension of this Campaign, YTLC may, at its sole and absolute discretion, choose not to proceed with the Participants selection process and/or the Campaign. - Disruption of Campaign.
Without prejudice to Clause 1 above, if for any reason this Campaign is not capable of running as planned or is disrupted for reasons due to and including without limitation network failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of YTLC or any party responsible for the running of any aspect of this Campaign, YTLC reserves all rights to hold void, cancel, suspend or amend this Campaign and these terms and conditions where it comes necessary to do so in YTLC’s absolute discretion, without prior notice or liability to any party. YTLC shall not accept any responsibility for any Campaign entries not received for whatever reason. YTLC shall not be responsible for any technical errors or service disruption in telecommunications networks, internet access or otherwise preventing participation to this Campaign. - Disclosure Rights.
By participating in this Campaign, each Participant grants to YTLC express permission as well as a non-exclusive, royalty-free, worldwide license to publish, print, reproduce, disseminate or share such Participant’s participation, name, video footage, voice, photograph and/or likeness and identity (excluding any sensitive personal data as defined by the Personal Data Protection Act 2010) for editorial, advertising, promotional, Campaign, marketing or other purposes, without further compensation, for an unlimited period of time, in any of YTLC’s publications, in any form or any media, whether for public consumption or otherwise, unless prohibited by law. Each Participant further confirms that by participating in this Campaign, he/she has read and agreed to the terms in the YTL Group Privacy Policy available at ytl.com/privacypolicy.asp, and consents to the processing of the Participant’s personal data by YTLC for the purposes stated in the YTL Group Privacy Policy, including for this Campaign. - Disqualification and/or Rejection of Entries.
YTLC reserves the right to disqualify any Participant at its sole and absolute discretion on the grounds of non-compliance with any of the Campaign Terms herein. For the avoidance of doubt, the foregoing is not meant to limit or curtail the rights of YTLC, who may also reject a Participant without having to assign any reasons whatsoever. Each Participant accepts that a decision to disqualify and/or reject a Participant shall be final and not subject to appeal. In the event of a disqualification after the Campaign has been given, YTLC reserves the right to demand the return of the Products or payment of its value from the ineligible or disqualified Participant. - General Indemnification.
Each Participant shall indemnify YTLC against all and any demands, claims, costs, expenses, damages, liability or injury (whether physical in nature or against the reputation of any party) incurred by YTLC, arising out of or relating to the Participant’s participation in this Campaign and/or Participant’s acceptance, use or misuse of this Campaign, including but not limited to the Participant’s acts, omissions, statements, publications whatsoever as may be in breach of any law or legal rights, as the case may be. - Third Party’s Rights and Indemnification.
By participating in this Campaign, each Participant warrants that (a) all personal details are the Participant’s own information; and (b) all answers, responses and/or entries submitted in this Campaign are true, accurate and original to the Participant and that no other party has any rights to such information or materials. Each Participant agrees to indemnify and keep indemnified YTLC against all claims, losses, damages and/or expenses whatsoever arising from any infringement or violation of any third party’s rights in relation to participation in this Campaign. - Survivability of Terms.
Any delay, waiver, non-enforcement, modification, amendment, withdrawal or substitution of any term or condition contained herein shall not affect the operation of the other terms or conditions so affected by such a waiver, non-enforcement, modification, amendment, withdrawal or substitution which shall remain in full force and effect. - Non-compliance.
Failure to comply with these Campaign Terms may result in the disqualification of the relevant Participant. - Instagram Promotion Guidelines
This Campaign is in no way sponsored, endorsed or administered by, or associated with Instagram. Each Participant acknowledges that the information and contents provided by such Participant for this Campaign are to YTLC and not to Instagram and by participating this Campaign each Participant hereby expressly release Instagram from any responsibilities or liabilities in connection with this Campaign. Please refer to Instagram Promotion Guidelines at https://help.instagram.com/179379842258600. - Definitions.
The following words and expressions have the following meanings, except where the context otherwise requires:
“Device” means the devices specified in Clause 5.3 of the Campaign Terms.
“Claw Ticket” means the right to participate in the “Claw Your Way To the New iPhone” Campaign earned by the Participant in accordance with Clause 5.1 of the Campaign Terms.
“General Applicable Terms and Conditions” means the Applicable Terms and Conditions in accordance with Clause 3 of the Campaign Terms.
“iPhone” means the smartphone made and sold by Apple Inc.
“Products” means the products referred to in Clause 5.3 of the Campaign Terms.
“Campaign Day” means the “Claw Your Way to the New iPhone” Campaign which is held on 20th September 2024.
“Campaign Website” has the meaning given to it in Clause 5.1.1.
“Yes iPhone Plan” means the Yes Infinite Plus (with upfront payment) Service Plans Programme, Yes Infinite+ Postpaid Service Plans Programme and all such applicable Postpaid and/or Prepaid Service Plans for iPhone offered by YTLC from time to time with terms and conditions as published on www.yes.my/docs/tnc.
“Yes Postpaid RM1 iPhone + Plan” means the Service Plans referred to in Clause 7.1 of the Campaign Terms.
“Yes Store” means the Yes Experience Store at Lot 10 Shopping Centre, Kuala Lumpur.
