- The Programme.
The Infinite Cashback Postpaid Service Plans Programme (“Programme” or “Infinite Cashback”) is a time limited programme launched by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC”) operating under the brand name “Yes”.
By subscribing and/or using any of the Cashback Service Plan(s) (defined below), each Eligible Subscriber (defined below) agrees and acknowledges that he/she understands and agrees to abide by these Programme Terms (defined below). - Eligibility.
This Programme is open to all individuals residing in Malaysia and who are 18 years of age and above at the time of subscription (“Eligible Subscriber”) provided that the Eligible Subscriber do not have in aggregate, more than fifteen (15) existing Postpaid Service Plans registered with Yes. All personal details submitted must be accurate and complete and are subject to proof upon request by YTLC. - Applicable Terms and Conditions.
Save where expressly varied in these terms and conditions (“Programme Terms”), all terms and conditions in the Postpaid Service Terms and Conditions, Postpaid Service Plans Terms and Conditions, Infinite Postpaid Hotspot Add-On Terms and Conditions, Yes Mobile Number Portability to Infinite Plans Programme Terms and Conditions, Yes Mobile Apps Terms and Conditions and Infinite Supplementary Line Service Plan Terms and Conditions (collectively referred to as “General Terms and Conditions”) shall remain valid and incorporated to this Programme by reference. Notwithstanding anything to the contrary, in the event of conflict or inconsistency between the General Terms and Conditions and these Programme Terms, these Programme Terms shall prevail only to the extent to resolve such conflict or inconsistency. Unless otherwise defined in these Programme Terms, the words in capital not defined herein shall have the same meaning ascribed to them in the General Terms and Conditions. - Programme Period.
The Programme commences on 20th September 2024, and continues until such other date as may be determined by YTLC, at its sole discretion from time to time (“Programme Period”). - Service Offerings.
During the Programme Period:
5.1 The Infinite Cashback allows Eligible Subscribers to purchase an iPhone and/or Device upfront with a Cashback Service Plan with the ability to terminate the Cashback Service Plan at any time, whilst earning monthly cashback of up to thirty-five (35) months. The Eligible Subscriber can terminate the Cashback Service Plan at any time without being liable to Early Termination Charges or penalty. The service plans offered under this Programme for subscription by the Eligible Subscribers are:
(a) Infinite Cashback Basic Postpaid Service Plan;
(b) Infinite Cashback Standard Postpaid Service Plan;
(c) Infinite Cashback Premium Postpaid Service Plan; and
(d) Infinite Cashback Ultra Postpaid Service Plan,
(hereinafter shall be collectively referred to as the “Cashback Service Plan(s)”).
5.2 Each Cashback Service Plan is a Postpaid Service Plan consist of:
(a) a Device, (please refer to yes.my on the smartphone available under the Programme;
(b) a Yes e-SIM Card or Yes SIM Card containing a unique Yes Mobile Number (“Yes SIM”); and
(c) monthly cashback for a maximum duration of thirty-five (35) months (“Cashback Period”) over payment of the Cashback Service Plan (“Cashback”).
5.3 Cashback Conditions. To be entitled to the Cashback, the Eligible Subscriber shall, during the Cashback Period:
(a) activate the Yes SIM within the time stipulated hereto pursuant to these Programme Terms;
(b) pay the monthly Commitment Fee and there shall not any unpaid or outstanding Commitment Fee;
(c) not change, upgrade or downgrade the Cashback Service Plan; and
(d) not have a Service Account (defined below) that is barred or suspended. If the Eligible Subscriber’s Service Account is barred or suspended on the applicable Cashback payout date, the Eligible Subscriber will not be entitled to receive the Cashback for such Service Account that is barred or suspended. “Service Account” shall mean the Eligible Subscriber’s account in respect of the Cashback Service Plan.
5.4 Cashback Payout. The Cashback will be credited to the Eligible Subscriber’s wallet in the MyYes app within sixty (60) days from the date of activation of the Yes SIM and thereafter on the thirtieth (30th) day for each subsequent month for a period of up to thirty-five (35) months. The Cashback is transferrable to a bank account and can be used to purchase all such products, goods, and Services offered by Yes.
5.5 Upon the termination of a Service Account under the Cashback Service Plan, the Eligible Subscriber shall:
(a) not be required to pay any Early Termination Charges;
(b) no longer entitled to the Cashback and shall be exempted from claiming any Cashback in respect of the Cashback Service Plan; and
(c) pay all such applicable charges (if any) imposed on any products, goods and/or Services subscribed or used by the Eligible Subscriber at such applicable rates as published on the Yes website, visit yes.my/tnc.
For the avoidance of doubt, if the Cashback Service Plan’s termination effective date is before the applicable Cashback payout date, the Eligible Subscriber shall not be entitled to the Cashback.

5.7 SIM Card and eSIM Activation.
(a) The Eligible Subscriber who has subscribed to the Cashback Service Plan online my or the MyYes app is required to activate the Yes SIM through the MyYes app. This one-time activation of the Yes SIM is mandatory and shall be done within a period of thirty (30) days from the date of registration of the Cashback Service Plan, failing which the Yes SIM will be deactivated without notice to the Eligible Subscriber.
(b) For eSIM activation, once the eSIM is activated, the Eligible Subscriber is required to download the Yes eSIM profile (“Yes eSIM Profile”) to allow the Device to connect to the Yes network to enjoy the Service. Please refer to my/e-sim for more information.
5.8 To enjoy 5G services by Yes, the Eligible Subscriber is required to use the Device with the Yes SIM, or any other compatible devices. Please visit www.yes.my/supported-devices/ to determine which devices support the Yes SIM.
5.9 The Eligible Subscriber may enjoy the service offerings with uncapped 5G and/or 4G speed (however, the internet speed will vary depending on whether the Eligible Subscriber is in the area with 5G or 4G coverage).
5.10 The Hotspot Data Capacity Allocation may only be used during the relevant Billing Cycle. In the event there is any unused Hotspot Data Capacity Allocation at the end of a particular Billing Cycle, such unused balance Hotspot Data Capacity Allocation will not be carried forward to any of the succeeding Billing Cycle and there shall be no refund for the unused balance Hotspot Data Capacity Allocation.
5.11 If the Eligible Subscriber has fully utilised the Hotspot Data Capacity Allocation under the relevant Cashback Service Plan before the expiry of the relevant Billing Cycle, the Eligible Subscriber may purchase a Postpaid Data Add-On to enjoy hotspot internet data with no speed control. For purposes of clarity, any mention on speed shall mean the optimum speed which means the actual speed enjoyed by the Eligible Subscriber may vary depending on various other factors including but not limited to technical and environmental factors.
5.12 The unlimited On-Net Services is available only for usage in Malaysia only and applicable for communications between person-to-person personal use and may not be used for any other purposes, including but not limited to: monitoring services, transmission of broadcast, transmission of recorded material, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication or other commercial uses, Cellular Trunking Units (CTUs), or any other activities which do not consist of person-to-person use between individuals. - Charges & SST.
6.1 Save as expressly provided herein, there will be no charges imposed on domestic On-Net Service for voice calls and SMS and domestic Off-Net Service for voice calls. 6.2 Charges will be imposed for all International Roaming Service and IDD Service in accordance with the internet, voice calls and SMS rates published @ www.yes.my/roaming.

6.4 All charges stated in this Clause 6 are exclusive of SST, which shall be payable by the Eligible Subscriber. - Subscription Channels.
The Eligible Subscriber may subscribe to the Cashback Service Plan through the Yes online store, the MyYes app, Yes stores or Yes authorised dealers. - Warranty.
The Device provided under the Cashback Service Plan is subject to the Device manufacturer’s standard warranty. Please refer to the manufacturer’s warranty provided with the Device or on the manufacturer’s website to understand the details on protection coverage and duration of the manufacturer’s warranty.
- Exclusion of liability for use of the Device.
YTLC shall not be liable to any Eligible Subscriber and/or Eligible Subscriber or any person(s) claiming from them for any loss, damages or injury arising from the use of or inability to use the Device for any cause whatsoever.By agreeing to participate and/or subscribe in this Programme, each Eligible Subscriber agrees to be bound by these Terms and hereby accepts that YTLC’s decision is final and binding.
- Refund.
There shall be no refund in respect of the Cashback Service Plan as well as products, goods and/or Services subscribed or used by the Eligible Subscriber for any reason whatsoever.
- Termination.
Subject to the termination conditions stipulated in the General Terms and Conditions and in these Programme Terms, the Eligible Subscriber can terminate the Cashback Service Plan by issuing to YTLC a notice in YTLC prescribed format and supported by all required relevant documents for verification. - Limitation of Liability.
(a) By participating in this Programme, each Eligible Subscriber agrees and irrevocably and unconditionally undertakes to absolve YTLC of all liabilities and further agrees to indemnify YTLC on indemnity basis and hold YTLC harmless against any claim (including any third party claims) and against any loss, damage, cost or expense (including legal fees and costs) that YTLC may suffer or incur as a result of or in connection with this Programme.(b) YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Programme Terms.(c) To the fullest extent permitted by law, YTLC and its respective parent companies, subsidiaries, affiliates, licensees, directors, officers, employees, agents and independent contractors hereby expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose of enjoyment of the service offerings under this Programme. - Severability.
If any provision of these terms and conditions is held to be invalid or unenforceable, then such provision shall (so far as it is invalid or unenforceable) be given no effect and shall be deemed not to be included in these Programme Terms without invalidating any of the remaining provisions of these Programme Terms. - Waiver.
No failure or delay by YTLC in exercising any right or remedy provided by law under or pursuant to these Programme Terms shall impair such right or remedy or operate or be construed as a waiver or variation of it or preclude YTLC exercise at any subsequent time and no single or partial exercise of any such right or remedy shall preclude any other or further exercise of it or the exercise of any other right or remedy. YTLC’s rights and remedies under or pursuant to these terms and conditions are cumulative, may be exercised as often as deem appropriate and are in addition to YTLC’s rights and remedies under general law. - Laws.
These Programme Terms shall be governed by the laws of Malaysia and the parties submit to the exclusive jurisdiction of the Malaysian courts. - Modifications.
YTLC reserves the right to, at any time, add to, delete, vary or amend these Programme Terms or change or modify any aspect of the Programme, in whole or in part, at any time and from time to time, at its sole discretion without notice and without liability to the Eligible Subscriber or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend the Programme at any time before or during the Programme Period with notice to the Eligible Subscriber. Any cancellation, termination or suspension by YTLC of this Programme shall not entitle the Eligible Subscriber to any claim or compensation against YTLC for any and all loss or damage suffered or incurred by the Eligible Subscriber as a direct or indirect result of the act of cancellation, termination or suspension.
