- The Campaign
The Yes Welcome Back Campaign (“Welcome Back Campaign”) is a time-limited campaign by YTL Communications Sdn Bhd (“ YTLC”). - Eligibility
This Welcome Back Campaign is open to:
a. all Malaysian citizens/residents who have subscribed to any of the following plans:
i. a Yes Prepaid Service Plan or Yes Postpaid Service Plan (including a Prepaid Service Plan or Yes Postpaid Service Plan under the Learn From Home Programme); or
ii. a Yes 4G Broadband Bundle Plan or Fixed Wireless Internet Service Plan; or
iii. a Teachers Data Plan; and
b. any foreigner who has subscribed to a Prepaid Service Plan under the Learn From Home Programme, and whose Yes service account in respect of the above Service Plan has been terminated (but not blacklisted), or is inactive, as at the commencement of this Welcome Back Campaign (each an “Eligible Subscriber”). - Campaign Terms Acceptance
Subject only to the variations as expressly set out herein (“Campaign T&Cs”), all other terms and conditions incorporated in the Postpaid Service Terms and Conditions, Postpaid Service Plan Terms and Conditions, Prepaid Service Terms and Conditions, Yes 4G LTE Prepaid Plan Terms and Conditions, Yes 4G Broadband Bundle Plan and Fixed Wireless Internet Service available at www.yes.my/tnc shall remain valid and applicable to this Welcome Back Campaign (collectively referred as “General Applicable Terms and Conditions”). In the event of any inconsistency between the General Applicable Terms and Conditions and these Campaign T&Cs, these Campaign T&Cs shall prevail to the extent of any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to in the General Applicable Terms and Conditions. - Campaign Period.
This Welcome Back Campaign will commence on 2nd December 2020, 12:00 a.m. and continue until further notice (“ Campaign Period”). - The Welcome Back Campaign Bundle.
Eligible Subscribers who have registered and are approved in accordance with Clause 6 below will be entitled to receive the following:
a. for each approved Eligible Subscriber under clause 2a or 2b above:
i. FREE One (1) Yes Prepaid SIM Card with Yes Mobile Number; and
ii. FREE 10GB LTE Data with an Account Validity Period of thirty (30) days from the date of service activation.
b.for each approved Eligible Subscriber under clause 2a (iii):
i. FREE One (1) Yes Postpaid SIM Card with YES Mobile Number; and
ii. FREE 2GB LTE Data per Billing Cycle (“Data Allocation”). Each Data Allocation is valid for thirty (30) days from the date such allocation is credited by YTLC, save for the first credited Data Allocation, which is valid until the end of the relevant Billing Cycle applicable to the Eligible Subscriber, which may be less than thirty (30) days. Any unused Data Allocation in a given Billing Cycle will expire at the end of that Billing Cycle and cannot be carried forward to the next Billing Cycle, refunded, exchanged (for cash or other benefits) or transferred in any way.(All items listed in Clauses 5(a) and 5(b) above shall collectively be referred to as the “Welcome Back Campaign Bundle”). - Campaign Mechanism
a. Each Eligible Subscriber is entitled to register for one (1) Welcome Back Campaign Bundle only provided that the Eligible Subscriber does not have, in aggregate, more than five (5) prepaid service accounts with Yes or more than fifteen (15) postpaid service accounts with Yes.
b. A URL link will be provided to the Eligible Subscriber either via SMS and/or Email. The selected Eligible Subscriber must complete and provide the required information in the online form therein.
c. If the Eligible Subscriber meets all the above requirements, YTLC will notify such approved Eligible Subscriber and the Yes Prepaid SIM Card will be delivered via courier (“Delivery Agent”) to the approved Eligible Subscriber’s delivery address as stated in the online form. The Delivery Agent will verify the information provided by the approved Eligible Subscriber in the online form against the approved Eligible Subscriber’s original identification documents (MyKad, MyPR or MyTentera (as applicable) for Malaysian citizens/residents, and a valid passport and work permit identification card/student identification card (as applicable) for foreigners,) upon delivery of the Yes Prepaid SIM Card. The approved Eligible Subscriber is required to have his/her original identification documents ready for the verification by the Delivery Agent.
d. For clarity, in the event YTLC’s attempt to contact the approved Eligible Subscriber or to deliver the Yes Prepaid SIM Card is unsuccessful, then YTLC will deem that such approved Eligible Subscriber is not interested to continue with the Welcome Back Campaign Bundle and such Eligible Subscriber will not be entitled to re-register for the Welcome Back Campaign Bundle.
e. Once the approved Eligible Subscriber has received the Yes Prepaid SIM Card, the approved Eligible Subscriber must activate the Yes Prepaid SIM Card via the Yes self-care portal at www.yes.my/faq by selecting “Activate the SIM card that I have applied online” option and enter the approved Eligible Subscriber’s Order Number and his/her assigned Yes Mobile Number. - Limitation of Liability.
YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Welcome Back Campaign. - Laws.
This Welcome Back Campaign shall in all respect be governed by the laws of Malaysia. - Modifications.
YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Welcome Back Campaign, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend this Welcome Back Campaign at any time before or during the Campaign Period with notice but without any liability or compensation whatsoever.
