1. The Promotion.
   The Yes Prihatin Special Unlimited RM15 Add-On Promotion (” Promotion“) is a time-limited promotion by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC“).
2. Eligibility.
   This Promotion is open to all Yes Subscribers subscribing to any of the following Prepaid Service Plans (“Eligible Subscribers”) to access and use the Service via smartphones only and not any other devices (including huddles and home wireless modem):
   i. Yes Prihatin Huddle XS Plan;
   ii. Learn From Home Free Phone; and
   iii. Learn from Home Monthly 7GB Plan.
3. Terms and Conditions, Interpretations and Definitions.
   3.1 By participating in this Promotion, each Eligible Subscriber agrees that he/she has read and understood all the terms and conditions herein (“Promo Terms and Conditions“) and agrees to be bound by these Promo Terms and Conditions.
   3.2 Subject only to the variations as expressly set out herein, all other terms and conditions relating to the Prepaid Service available @www.yes.my/tnc (“Prepaid T&Cs”) shall remain and be applicable to this Promotion. In the event of any inconsistency between the Prepaid T&Cs and the Promo Terms and Conditions, these Promo Terms and Conditions shall prevail to the extent of any such inconsistences.
   3.3 All capitalised words shall unless otherwise provided, bear the same meanings as defined in this Promo Terms and Conditions or the Prepaid T&Cs.
4. Promotion Period.
   The Promotion commences on 4^th April 2022, 12:00 a.m. until further notice (“Promo Period”).
5. Promotion Description.
   The following preloaded data add-on pack is offered under this Promotion:-

   5.2 Eligible Subscribers who have subscribed to the Yes Prihatin Special Unlimited RM15 may purchase the Kasi Up Turbo 5GB. During the Service Validity Period of the Yes Prihatin Special Unlimited RM15, an Eligible Subscriber is not entitled to purchase any other Prepaid LTE Data Add-On offered by YTLC except for Kasi Up Turbo 5GB or Prepaid Hotspot Add-On.

   5.3 (a) Subject to Clause 5.3(b) herein, an Eligible Subscriber is only entitled to subscribe to one (1)  Yes Prihatin Special Unlimited RM15 during the Service Validity Period which means multiple subscriptions of Yes Prihatin Special Unlimited RM15 is not allowed.

   (b) Notwithstanding the provision in Clause 5.3(a) above, an Eligible Subscriber may subscribe to a Yes Prihatin Special Unlimited RM15 five (5) days prior to the expiration of his/her Yes Prihatin Special Unlimited RM15 Service Validity Period. For clarity and by way of illustration only, if an Eligible Subscriber had subscribed to a Yes Prihatin Special Unlimited RM15 on 16th March 2022, the Service Validity Period of such Yes Prihatin Special Unlimited RM15 is until 15th April 2022. The Eligible Subscriber is only entitled to subscribe to a Yes Prihatin Special Unlimited RM15 (provided that the Promotion is still ongoing), or any other Prepaid LTE Data Add-On, at any time after the 10th April 2022.

   5.4 In the event an Eligible Subscriber commits a breach of the Promo Terms and Conditions (“Defaulter”), YTLC reserves the right to throttle the Defaulter’s use of the Service to 256kbps without prior notice to the Defaulter. A Defaulter will need to subscribe to the “Unthrottle Me Data Add-On” via MyYes app to continue enjoying the Service at unthrottled speed.

   5.5 In the event an Eligible Subscriber subscribes to the Yes Prihatin Special Unlimited RM15 during the Account Validity Period of any Prepaid LTE Data Add-On previously subscribed, the data remaining in the aforesaid Prepaid LTE Data Add-On shall be firstly utilised subject to such Prepaid LTE Data Add-On’s Account Validity Period before utilisation of the internet data in the Yes Prihatin Special Unlimited RM15.

   5.6 Once the internet data of 9GB for the use of hotspot is fully utilised, an Eligible Subscriber will not able to use the hotspot during such Account Validity Period.

   5.7 Service speeds, if stated, are on best effort basis. Factors such as coverage, location, building interference, distance from communications towers and number of concurrent users may affect the Service speed and Service performance (voice and/or SMS).

   5.8 The Yes Rebates is not applicable to this Promotion.

6. Limitation of Liability.
   YTLC shall not be liable for any loss or damage (including without limitation loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Promotion.
7. Termination.
   The Yes Prihatin Special Unlimited RM15 purchased by an Eligible Subscriber shall be automatically terminated without any refund to an Eligible Subscriber upon termination of such Eligible Subscriber’s Service account.
8. Laws.
   This Promotion shall in all respects be governed by the laws of Malaysia and by participating in the Promotion, the Eligible Subscribers submits to the exclusive jurisdiction of the courts of Malaysia.
9. Modifications.
   YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Promotion, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend this Promotion at any time before or during the Promo Period with notice but without any liability or compensation whatsoever.
