1. The Programme.
   The Yes Prihatin RM20 Unlimited Add-On Programme (” Programme“) is a time-limited Programme by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC“).

2. Eligibility.
   This Programme is open to all Yes Subscribers subscribing to any of the following Prepaid Service Plans (“Eligible Subscribers”) to access and use the Service via smartphones only and not any other devices (including huddles and home wireless modem):
   i. Yes Prihatin Learn from Home for Families;
   ii. Yes Prihatin Learn from Home for Individuals; and
   iii. Yes Prihatin Prepaid Plan.
3. Applicable Terms & Conditions:
   Subject only to the variations as expressly set out herein (“Programme T&Cs”), all other terms and conditions incorporated in the Prepaid Service Terms and Conditions, Prepaid Data Add-On Terms and Conditions, Prepaid Hotspot Add-On Terms and Conditions, and Yes Jaringan Prihatin Service Plan Terms and Conditions available at yes.my/tnc (collectively referred as “General Applicable Terms and Conditions”) shall remain valid and applicable to this Programme. In the event of any inconsistency between the General Applicable Terms and Conditions and these Programme T&Cs, these Programme T&Cs shall prevail to the extent of any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to in the General Applicable Terms and Conditions.

4. The Programme.
   The Programme commences on 16^th August 2024 until further notice (“Programme Period”).

5. Programme Description.
   5.1 The following preloaded data add-on pack is offered under this Programme:-

   5.2 (a) An Eligible Subscriber is only entitled to subscribe to one (1) Yes Prihatin RM20 Unlimited Add-On Programme at a given time. However, an Eligible Subscriber may renew their subscription to said Programme five (5) days prior to the expiration of his/her Yes Prihatin RM20 Unlimited Account Validity Period.

   (b) An Eligible Subscriber is not allowed to further subscribe to any other add-ons during the Yes Prihatin RM20 Unlimited Account Validity Period.

   5.3 In the event an Eligible Subscriber subscribes to the Yes Prihatin RM20 Unlimited during the Account Validity Period of any Prepaid Data Add-On previously subscribed, the data remaining in the aforesaid Prepaid Data Add-On shall be firstly utilised subject to such Prepaid Data Add-On’s Account Validity Period before utilisation of the internet data in the Yes Prihatin RM20 Unlimited.

   5.4 Once the internet data of 12GB for the use of hotspot is fully utilised, an Eligible Subscriber will no longer be able to use the hotspot during such Account Validity Period.

   5.5 After the Service Validity Period, the Eligible Subscriber may purchase the Prepaid Plan Data Add-On or Hotspot Add-On (as the case may be) as specified in the Prepaid Data Add-On Terms and Conditions or the Prepaid Hotspot Add-On Terms and Conditions (as applicable).

   5.6 The Eligible Subscriber may enjoy the service offerings with uncapped 5G/4G speed (Internet speed will vary depending on whether the Eligible Subscriber is in 5G or 4G coverage).

   5.7 The unlimited voice call or SMS services are exclusive for the Eligible Subscriber’s personal person-to-person communications use in Malaysia only. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuous call forwarding, auto-dialling, machine-to-machine communication (including by using the Eligible Subscriber’s 5G SIM Card in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and is therefore prohibited.

   5.8 In the event a Yes Subscriber commits a breach of the Programme T&Cs (“Defaulter”), YTLC reserves the right to throttle the Defaulter’s use of the Service to 256kbps without prior notice to the Defaulter. A Defaulter will need to subscribe to the “Unthrottle Me Data Add-On” via MyYes app to continue enjoying the Services at unthrottled speed.

6. Limitation of Liability.
   YTLC shall not be liable for any loss or damage (including without limitation loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Programme.
7. Termination.
   The Yes Prihatin RM20 Unlimited purchased by an Eligible Subscriber shall be automatically terminated without any refund to an Eligible Subscriber upon termination of such Eligible Subscriber’s Service account.
8. Laws.
   This Programme shall in all respect be governed by the laws of Malaysia.
9. Modifications.
   YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify or terminate or suspend any aspect of this Programme, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party.
